Terms of Use
Effective: October 27, 2026 · Last updated: October 27, 2026
What changed: how you agree to these terms, the license grant, the liability limit (US$100), who owes an indemnity, governing law and disputes, and a names-and-trademarks section.
These terms are a contract between you and Kurtis Alexander ("we", "us") about Moose Tracker, including the website, the music engine, the exporter, the sound library, and any API or MCP connection we offer (together, the "Service"). By using the Service you agree to these terms. If you do not agree, please do not use it. If you are under the age of majority where you live, please read these terms with a parent or guardian. Rules for automated use are in the API & MCP terms. What you may do with songs and sounds is in the Content license; how we handle data is in the Privacy. Those pages are part of these terms.
1. Our software, your music
The Service's software, engine, source code, design, name and logo are owned by Kurtis Alexander and are proprietary. All rights are reserved except the license in section 2. Music you make is yours (see the Content license).
2. License to use the Service
Subject to these terms, we give you a free, worldwide, non-exclusive, non-transferable, non-sublicensable license to access and use the Service, including running its code in your browser, for any lawful purpose, including commercial music-making. We can end this license as described in section 9. It covers the software and website only; the sounds, demos and music are covered by the Content license. We keep all rights we do not expressly give you, and nothing in these terms transfers ownership of the Service to you.
3. What you may not do
- Copy, redistribute, sell, rent, sublicense or host the Service or its code, in whole or in part, other than as these terms or the Content License allow.
- Reverse engineer, decompile, disassemble or try to extract the source code of the engine or the Service, except (a) to the extent applicable law allows it despite this restriction, and (b) as needed to modify the lamejs MP3 library or another third-party component and debug your changes, where that component's license (for example, section 4 of the GNU LGPL v3 for lamejs) gives you that right.
- Remove or alter copyright, license or attribution notices.
- Use the Service to infringe other people's rights, to break the law, or in ways that harm the Service or others (see API & MCP terms).
- Use our name or logo in a way that suggests we endorse you or your product.
Third-party components included in the Service are licensed under their own terms, listed in the Third-party notices. Nothing in these terms limits rights you have under those licenses.
4. Your content
You keep all rights in the music, samples and other material you create or import. We do not receive your songs when you use the website, so we need no license to them. The one exception is the API/MCP render service: when you or an assistant ask it for audio, it processes the song text to make the file and keeps the audio only temporarily, about 2 hours (see Privacy). If you send us ideas or feedback, we may use them without owing you anything. Anything else you send us (for example, by email) we will use only to respond to you.
5. The Service may change
The Service is provided free and may change, be limited, or be stopped at any time, with or without notice. We do not promise any level of availability, speed, or compatibility. Because your work is stored on your own device, please export and keep your own backups (.mtk files or audio exports).
6. Warranty disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL BE SECURE, THAT DATA STORED IN YOUR BROWSER WILL NOT BE LOST, OR THAT ANY SOUND OR OUTPUT WILL MEET YOUR NEEDS. Some places do not allow some of these exclusions, so some may not apply to you.
Audio can be loud. Start with your volume low and keep it at a level that is safe for your ears and your equipment.
7. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, KURTIS ALEXANDER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST DATA, LOST PROFITS OR LOST REVENUE, ARISING OUT OF OR RELATED TO THE SERVICE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED US$100.
The Service is free, and these limits are part of why it can be. Nothing in these terms excludes or limits liability for fraud, willful misconduct, death or personal injury caused by negligence, or anything else that cannot be excluded or limited by law.
8. Responsibility for what you import and publish
You are responsible for material you import into the Service and for what you publish with it. If you use the Service for a business or organization, or you operate an assistant or program that uses our API or MCP service, you will defend and hold Kurtis Alexander harmless from third-party claims, losses and reasonable costs (including reasonable legal fees) arising from your breach of these terms or from material you submit or publish using the Service, except to the extent caused by our own willful misconduct. Individuals using the Service for personal music-making have no indemnity obligation under these terms.
9. Termination
You may stop using the Service at any time. We may suspend or end your access, including by blocking an address or API key, if you break these terms or if we need to protect the Service. Sections that by their nature should survive (including 1, 3, 4, 6, 7, 8, 11 and 13) survive termination. Termination does not affect your ownership of your music.
10. Changes to these terms
We may update these terms. The "Last updated" date above shows when. Changes apply from the date they are posted (the same rule applies to Privacy). Continuing to use the Service after that means you accept them. Changes do not take away your rights in music you have already made.
11. Governing law and disputes
These terms and any dispute about the Service are governed by the laws of the State of Indiana, USA, without regard to its conflict-of-laws rules. If you are a consumer, mandatory consumer-protection laws of the place where you live still apply to you. Before starting a formal claim, please email moose@moosetracker.app and give us 30 days to try to fix the problem. Any claim that is not resolved will be brought only in the state or federal courts located in Indiana, and you and we consent to those courts' jurisdiction, except that (a) either of us may seek urgent relief against infringement or misuse of intellectual property in any court that has jurisdiction, and (b) if you are a consumer, nothing here removes any right you have under mandatory law to sue or be sued in the courts where you live.
12. General
- Entire agreement. These terms (with the pages they refer to) are the entire agreement about the Service and replace earlier understandings about it.
- Severability. If a part of these terms is found unenforceable, the rest stays in effect and that part is enforced as far as the law allows.
- No waiver. Not enforcing a term is not a waiver of it.
- Assignment. You may not assign these terms without our written consent. We may assign them, for example to a successor owner of the Service.
- Export laws. You will follow applicable export and sanctions laws when using the Service.
13. Names and trademarks
Moose Tracker and the moose logo are unregistered trademarks of Kurtis Alexander. You may say your music was made with Moose Tracker and link to the site. Please do not use the name or logo as the name of your own product or in a way that suggests we sponsor or endorse you. Other product names that appear in the Service (for example Moog, Juno, Prophet, CS-80, 808, 909 and 303) belong to their owners, are used only to describe the style of a sound, and do not mean we are affiliated with them.
